I listened to the latter part of the Supreme Court hearing today on federal judges issuing nationwide injunctions. Wow. Talk about smart people thinking on their feet! I was extremely impressed by the lawyer representing New Jersey. He had instant recall on cases and was so quick, logical and well spoken in his responses to the justices’ questions, using the opportunity to answer their questions while a t the same time advocating for his client’s position.
I thought the justices demonstrated their extraordinary intellect with their piercing questions.
Alito said something that surprised me. He said that of the 680+ federal judges “sometimes they get it wrong” seemingly to suggest that they may overstep their authority. Isn’t the answer to that the appeals process?
What the Government seems to be saying is that in those states that haven’t sued over the 14th amendment that the government should be able to deny birthright citizenship in those states until the Supreme Court rules on that matter. That position seems obscene to me. Birthright citizenship is not a state matter; it is a federal matter.
But I’m not a lawyer!
